Your access to the Dynasty Tire’s website or online services (collectively, “Platform”) is subject to the following Terms of Use in force from the 09/25/2023. We may modify these Terms of Use from time to time at our sole discretion. Please read these Terms of Use carefully before utilizing this Platform.

Dynasty Tire, and its parents, subsidiaries, affiliates, agents, or authorized representatives (collectively “Dynasty Tire”) own and operate the Platform. The Platform is only available for United States residents who have attained the age of eighteen (18) years or above. Usage of our Platform by users outside the United States or under 18 years of age is prohibited. By accessing or using this Platform in any manner, including but not limited to browsing the Platform, retrieving information, and/or submitting information, you consent to and are bound by these terms, conditions, policies, and notices enshrined in this document (the “Terms”), including, but not limited to, binding arbitration, conducting this transaction electronically, accepting disclaimers of warranties, acknowledging damage and remedy exclusions, and limitations, and you nominate under the laws of Florida for the resolution of any disputes.

Dynasty Tire reserves the right to,

at its sole discretion, modify this Platform and these Terms at any given time. Continued usage of this Platform after the modifications of the Terms signifies your acceptance of such changes. You are responsible for periodically reviewing these Terms to stay updated with the most recent version. We may, at any point, render this Platform or any part thereof discontinued with or without notice, or prevent your use of this Platform with or without notice to you. You acknowledge that you do not have any rights in this Platform, and Dynasty Tire will have no liability to you if this Platform is discontinued or your ability to access our Platform is terminated for whatever reason.

Binding Arbitration

Any dispute or claim arising from your use of the Platform, these Terms or our Privacy Policy shall be determined by binding arbitration before Judicial Arbitration and Mediation Services (“JAMS”) in a location decided by the arbitrator (designed to be reasonably convenient for you), or another agreed location by both parties. The dispute will be resolved according to the commercial dispute rules provided by Comprehensive Arbitration Rules and Procedures of JAMS (“JAMS Rules and Procedures”) currently in force.

Any rights not expressly granted herein are reserved by Dynasty Tire. All contents included as part of the platform, such as text, graphics, logos, images,

as well as the compilation thereof, and any software used on the Platform, is the property of Dynasty Tire or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights.

Your usage of the Platform does not give you ownership of any intellectual property rights in any of the content accessed. All remarks, suggestions, ideas, graphics, or other information communicated by you to us will forever be our property.

Accounts, Passwords, and Security

If the Platform requires you to create an account or submit information, you must complete the specified process by providing us with current, complete, and accurate information. You are entirely responsible for maintaining the confidentiality of your account and password. Moreover, you are entirely responsible for any and all activities that occur under your account.

Representations, and Limitations of Liability

Dynasty Tire makes no representations about the reliability of the features of this Platform, the Dynasty Tire Content, User Content, or any other Platform feature, and disclaims all liability in the event of any service failure. You acknowledge that any reliance on these materials will be at your risk.

This Platform may hyperlink to sites, software, or services owned or operated by third parties. Dynasty Tire does not control such linked websites and is not responsible

for their content, or any changes or updates to such sites. Dynasty Tire provides these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Dynasty Tire of the website.

Miscellaneous

Both you and Dynasty Tire acknowledge and agree that no partnership is formed, and neither of you nor Dynasty Tire has the power or the authority to obligate or bind the other.

These Terms will be effective as of the date set forth above and will continue in effect unless and until these Terms are terminated by Dynasty Tire. Dynasty Tire reserves the right, at its sole discretion, to change, suspend, or terminate your access to the Platform, or any portion thereof, or these Terms, in whole or in part, at any time for any reason without prior notice or liability.

These Terms constitute a binding agreement between you and Dynasty Tire, as defined herein, and is accepted by you upon your use of the Platform or your account. These Terms constitute the entire agreement between you and Dynasty Tire regarding the use of the Platform and your account. By using the Platform you represent that you are capable of entering into a binding agreement, and that you agree to be bound by these Terms.
